Litigation & Disputes

When a dispute can't be avoided, experience matters. Will Montague has litigated for more than three decades — often as lead counsel — in federal and state courts, in cases with an intellectual property angle and in plenty without one.

A Litigation Practice, Not a Sideline

Montague Law handles business disputes of every stripe. Alongside trademark, copyright, patent, and trade secret cases, Will has served as lead counsel or played a significant role in contract and franchise disputes, partner and LLC member fights, unfair competition claims, banking and bankruptcy adversary proceedings, insurance liquidation matters, and litigation in the health care and equine industries — the kind of docket that only comes from decades of trying to solve real business problems, not just IP problems.

The practice spans three fronts, each with its own page and its own representative matters — actual cases, with courts and case numbers:

How We Approach a Dispute

We start with an honest assessment: the strength of your position, the realistic outcomes, and the cost of each path. Litigation is a tool, not a reflex — many disputes resolve best through a firm letter, a negotiation, or mediation or arbitration, and we will tell you when that's true. When court is the right answer, we prosecute or defend the case with the same practical focus: your business objective, not the fight for its own sake.

The place to start is an initial consultation ($175, up to 30 minutes, credited to your first bill if you retain us). Litigation is generally billed hourly; see Our Fees for how we bill and what to expect.
